Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Wall Stare ("Wall Stare," "we," "us," or "our") governing your use of the Wall Stare mobile application and related services (the "App"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or guardian.

2. License

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, for your own personal, non-commercial use. We reserve all rights not expressly granted.

3. Health and wellness disclaimer

The App is not a substitute for professional care. Do not use the App in any situation where it could distract you from activities that require your full attention (for example, while driving or operating machinery). Staring exercises may cause eye strain or fatigue for some people; stop and rest if you feel discomfort. If you have any medical or mental-health condition or concern, consult a qualified professional before using the App. You use the App at your own risk.

4. Accounts

Some features require an account, which you can create using Sign in with Apple, Google, or an email address and password. You are responsible for activity that occurs under your account and for keeping access to your device secure. You agree to provide accurate information and not to impersonate others or choose a display name, username, or avatar that is offensive, infringing, or misleading. You may delete your account at any time from Settings → Account → Delete account.

5. Subscriptions and payments

The App may offer auto-renewing subscriptions ("Pro") and other in-app purchases.

• Billing. All purchases are processed by Apple through your Apple Account and are subject to Apple's terms. Prices are shown in the App before purchase.
• Auto-renewal. Subscriptions automatically renew for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the period ends.
• Managing and canceling. You can manage or cancel your subscription in the App Store account settings on your device (also reachable from Settings → Account → Manage Subscription). Deleting the App does not cancel a subscription.
• Free trials. If a free trial is offered, any unused portion is forfeited when you purchase a subscription.
• Refunds. Purchases are handled by Apple, and refunds are subject to Apple's policies. We generally cannot issue refunds directly.

Your use of the App is also governed by Apple's standard Licensed Application End User License Agreement (EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms conflict with that EULA, that EULA controls for matters it covers.

6. Acceptable use

You agree not to:

• use the App for any unlawful purpose or in violation of these Terms;
• reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by law;
• interfere with or disrupt the App, its servers, or its security;
• attempt to access accounts, data, or systems that are not yours;
• harass, abuse, or harm other users, including through cohort or leaderboard features; or
• submit content that is illegal, infringing, hateful, or otherwise objectionable.

We may suspend or terminate access for conduct that violates these Terms.

7. User content

You retain ownership of the content you provide (such as your display name and profile photo). You grant us a limited license to use, host, and display that content as needed to operate the App, including showing your name and avatar to other participants in cohorts and leaderboards. You are responsible for the content you submit and represent that you have the rights to it.

8. Intellectual property

The App, including its software, design, text, graphics, and branding, is owned by Wall Stare and its licensors and is protected by intellectual-property laws. These Terms do not grant you any rights in our trademarks or other intellectual property except the limited license above.

9. Third-party services

The App relies on third-party services, including Apple, Google, Supabase, Resend, PostHog, Sentry, and Superwall. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services.

10. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that any results (such as improved focus or stillness) will be achieved. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

11. Limitation of liability

To the maximum extent permitted by law, Wall Stare and its owners and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the App. To the maximum extent permitted by law, our total liability for any claim relating to the App will not exceed the greater of (a) the amount you paid us for the App in the 12 months before the claim, or (b) USD $50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Wall Stare from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the App or violation of these Terms.

13. Termination

You may stop using the App at any time and delete your account. We may suspend or terminate your access if you violate these Terms or if we discontinue the App. Sections that by their nature should survive termination (such as disclaimers, limitations of liability, and indemnification) will survive.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Effective date" above and, where appropriate, provide additional notice in the App. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

15. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Wyoming, unless applicable law requires otherwise.
